What will happen when I contact you?
We are going to have a conversation. Whether you want to talk on the phone, at your house or at our office, we will ask you some questions about the incident and your injuries, and we will answer any questions that you have for us.
There is no cost for this conversation, and there is no obligation. We want you to obtain the information that you need to make a decision about how you will move forward.
Some of the questions that we may ask you are:
- What happened? When, where and how.
- How have you been injured?
- Do you need help getting access to medical treatment?
- Are you off work because of your injuries?
We have made a list below of some of the questions that you might like to have answered.
I've been injured. What should I do now?
If you've been injured at work, in a car accident or in a public place, we recommend that you take the following steps:
- Seek medical treatment: Whether it is at the hospital or with your GP, make sure that you report the incident and your injuries, and get the medical attention you need as soon as possible;
- Report the incident: You need to notify whoever is responsible. This might be telling your employer and completing an incident report, notifying the Queensland Police, or wherever your injury occurred.
- Gather information: If possible, take photos of your injuries or where the incident occurred, write down the details of the people involved or any witnesses, and keep track of any of your expenses so that they can be reimbursed later.
- Obtain advice and consider lodging a claim: There are strict time limits in Queensland for when you can lodge your claim. It is important that you know your options from the beginning. Lodging a claim early will also help you to get funding for medical treatment, to improve your chances of making a full recovery.
I have not been able to afford any rehabilitation, can you help?
Lodging a claim early will give you the best chance of getting funding for medical treatment. For injuries at work or motor vehicle accidents, the insurers are required to fund your reasonable medical treatment (GP, physiotherapy, psychologist, surgery etc), and we can help you to get these requests submitted and over the line.
In certain circumstances, we can also assist with funding your medical treatment on your behalf, to make sure that you have the best chance of getting back on track.
We will also help you to find appropriate treatment providers for your injuries, if you are having trouble with this.
How will I be charged?
We work a on a "No Win No Fee" basis. This means that:
- You won't pay anything upfront; and
- You will only pay any legal fees if your claim if successful.
We take on the risk and we will only act for you if we think that you have a good chance of succeeding.
Your fees will be calculated based on the time it takes for us to work on your claim. Unlike a lot of firms, we don't charge any extra "uplifts" or "care and consideration"; you are only charged for the work we do. We also cap our legal fees depending on your outcome.
And because we are a small team, and you are working directly with our founders, there is no time wasting or double handling of your file. This means less time charged, and more for you in your pocket at the end.
How much is my claim worth?
Every claim is different, and what you will receive will be based on what injuries you have and how they affect you.
However, there are categories of compensation that we can claim for you:
- Employment - for a lot of people, this can be the biggest part of their claim. We will claim for any time off work you've had, any missed job opportunities, and the future impact of your injuries (including changes in employment or inability to return to work, ongoing difficulties at work, career progression, early retirement etc);
- Out of pocket expenses - you shouldn't have to be out of pocket for something that is not your fault. We will claim back the cost of any expenses that you've paid, as well as the cost of future expenses (such as medical treatment, equipment and support services);
- Pain and suffering - injuries can have a broad impact on you, your lifestyle and your family. We will claim for the cost of this pain and suffering for each of the injuries that you've had.
We may estimate the potential value of your claim at the outset.
Will it even be worthwhile?
We can help you to make this decision, based on your individual circumstances.
We are not going to lead you down the garden path - if we don't think your claim is worthwhile bringing, we will let you know at the outset. We will talk to you about any risks involved and what your claim might be worth, so that you can make a fully informed decision about whether you want to proceed.
In making this decision, it is important to remember that:
- Even if your injuries seem minor, they are most likely permanent. The claim is there to compensate you for the long-term effects of this; and
- You are not at risk financially. If your claim does not succeed, we will not charge you.
How long is this going to take?
This is not a quick process. Depending on the severity of your injuries, it might take a few months or a few years for your injuries to stabilise.
We always recommend lodging your claim as soon as possible, so that we can run your claim "in the background" while this time is passing and you are focusing on your recovery.
The average time frame though, is between about 9 and 18 months from when you injury happens, to when the claim might resolve.
Will I need to go to court?
This is very unlikely. The system is set up so that the majority of claims are resolved by negotiating the outcome with the other side, rather than having a judge intervene and make the decision for you.
Do I even need a lawyer?
No - if you want to go it alone, you can.
But be careful. The person on the other side of your claim, most likely an insurer or someone representing them, is not your friend. They are not on your side and they will want to resolve your claim for the lowest possible amount. And once you settle your claim, there is no coming back; you only get one chance at this.
If you've been injured, this is not the time to cut corners. Get advice from someone that you can trust, someone that will get to know you and your needs, and will fight to get the best possible outcome for you.
